Fortis Media provides the following services to local service businesses across the UK:

• Website design and development

• Search engine optimisation (SEO)

• Content creation and copywriting

• Brand strategy and identity

• Social media strategy

• The Fortis Presence System — our structured digital presence programme

The specific scope, deliverables, timelines, and fees for any engagement will be agreed in a separate written proposal or service agreement before work commences.

3. Client Obligations

When engaging our services, you agree to:

• Provide accurate, complete, and timely information required to deliver the agreed services.

• Supply any necessary materials (logos, images, copy, brand guidelines) within agreed timeframes.

• Designate a primary point of contact for approvals and feedback.

• Respond to requests for feedback or approval within a reasonable timeframe (typically 5 working days).

• Ensure you have the legal right to use any materials you provide to us.

Delays caused by failure to meet these obligations may affect project timelines and are not the responsibility of Fortis Media.

4. Payment Terms

Unless otherwise agreed in writing:

• A deposit (typically 50% of the total project fee) is required before work commences.

• The remaining balance is due upon project completion and prior to final delivery or launch.

• Invoices are payable within 14 days of the invoice date.

• Late payments may incur interest at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

• All prices are quoted in GBP (£) and are exclusive of VAT unless stated otherwise.

We reserve the right to pause or suspend work on a project if invoices remain unpaid beyond the due date.

5. Intellectual Property

Our work: Upon receipt of full payment, Fortis Media assigns to the client full ownership of the final deliverables created specifically for that project (e.g. website design, written content, graphics).

Our tools and processes: We retain ownership of all proprietary tools, frameworks, methodologies, templates, and pre-existing intellectual property used in delivering our services.

Third-party assets: Any third-party assets (stock images, fonts, plugins, software licences) remain subject to their respective licence terms. We will inform you of any ongoing licence requirements.

Portfolio rights: We reserve the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes business strategies, pricing, client data, and any information marked as confidential.

This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

Confidentiality obligations survive the termination of any service agreement.

7. Cancellation & Termination

By the client: You may cancel a project at any time by providing written notice. Any work completed up to the point of cancellation will be invoiced and payable. Deposits are non-refundable unless Fortis Media is in material breach of the agreed terms.

By Fortis Media: We reserve the right to terminate an engagement if:

• Payment obligations are not met.

• You act in a manner that is abusive, unlawful, or contrary to these Terms.

• Continuing the engagement would require us to act unlawfully or unethically.

In such cases, you will be invoiced for all work completed to date.

8. Limitation of Liability

To the fullest extent permitted by UK law:

• Fortis Media's total liability for any claim arising from our services shall not exceed the total fees paid by you for the specific project giving rise to the claim.

• We are not liable for any indirect, consequential, or special losses, including loss of profit, loss of business, or loss of data.

• We do not guarantee specific outcomes such as search engine rankings, lead volumes, or revenue increases, as these depend on many factors outside our control.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

9. Website Use

By using our website, you agree not to:

• Use the site for any unlawful purpose or in a way that infringes the rights of others.

• Attempt to gain unauthorised access to any part of the website or its underlying systems.

• Transmit any harmful, offensive, or disruptive content.

• Reproduce, distribute, or republish any content from this website without our prior written consent.

We reserve the right to restrict or terminate access to the website at our discretion.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
